A lawsuit alleging malfeasance by members of the Jefferson County Quorum Court that had been dismissed by a special judge has been reinstated.
On June 16, Judge William Wright dismissed the suit that had been filed by Garland Trice and five others , ruling that no action had been taken in the case but an attorney for Trice and the other plaintiffs said that the order was premature and Wright agreed, signing an order June 20 saying that the matter should not have been dismissed and he withdrew his previous order.
Specifically, Justices of the Peace Alfred Carrol, Reginald Adams, Reginald Johnson, Margarette Williams, Melanie Johnson Dumas, Cedric Jackson and Brenda Bishop Gaddy had contended that the case should be dismissed because their motion to that effect had not been answered.
However, the attorney for Trice responded to that motion on May 23, and Wright said that constituted action on the case.
Trice’s attorney also said it was a “miscarriage of justice” for their response to be ignored and for the order to stand.
In their original complaint, Trice and the other plaintiff’s asked that the offending Justices of the Peace be removed from office, for damages and attorney fees
