A civil lawsuit filed in Jefferson County Circuit Court against County Judge Gerald Robinson and several justices of the peace has been dismissed after a judge ruled the plaintiffs failed to present sufficient allegations for the court to consider any justiciable issues.
In an order filed Monday, Dec. 15, Special Judge Randall Wright granted motions to dismiss the plaintiffs’ Third Amended Complaint in the case of Morgan Tillman and Gloria Tillman, on behalf of herself and others similarly situated, vs. Gerald Robinson et al.
The lawsuit named several defendants in both their individual and official capacities, including Gerald Robinson, Roy Agee, Patricia Royal Johnson, Ted Harden, Jimmie Fisher and Conley Byrd.
According to the order, a hearing was held on Sept. 5, 2025, to consider motions to dismiss filed by Robinson and by the remaining defendants. After reviewing the pleadings and hearing arguments from counsel, the court found the allegations contained in the Third Amended Complaint were “not sufficient to provide a basis for this Court to consider any justiciable issues.”
As a result, Special Judge Wright granted the motions to dismiss. The dismissal was issued without prejudice, meaning the plaintiffs are not barred from refiling their claims if they choose to do so.
The order was entered into the record on Dec. 15, 2025.
