A circuit judge has ruled that County Judge Gerald Robinson failed to follow state law in the handling of a road improvement project and in responding to a public-records request — and has ordered him to correct both issues.
In an order signed Dec. 1, Circuit Judge William Wright found that Robinson did not comply with Arkansas Code § 22-9-203, which governs the procurement of bids for public projects. The case stems from a complaint filed by D & D Paving, Inc. and Mike Davis regarding work planned on Donham and Toler Roads.
Wright ordered Robinson to reopen the project for public bidding and to follow all bid-procurement requirements under state law. The order also requires Robinson to provide proper and detailed project specifications to all prospective bidders, citing examples included in the plaintiffs’ exhibits.
The court further ruled that Robinson did not comply with Arkansas Code § 25-19-105, a key section of the Arkansas Freedom of Information Act, when responding to a record request. Robinson must turn over all documents requested by the plaintiffs on Sept. 3, 2025, including all bid awards made to Cato Asphalt over the past three years.
