The Arkansas Court of Appeals on Wednesday ruled that Circuit Judge Mac Norton was correct when he dismissed an appeal by a Pine Bluff woman who contested a bill.
Modern Home Concepts of Arkansas sued Mary Brazil over the unpaid balance of a construction contract. Brazil denied she owed the bill and countersued the company but in October 2022 a district judge ruled for the company and said Brazil owed the company $8,766.50.
She appealed the judgement to Circuit Court but did not serve the company within the 120 days mandated by law and six months afterward, Norton dismissed her appeal.
She asked that the court reconsider the dismissal but because she failed to serve the company in the time frame allowed by law, and failed to ask for an extension of that 120 day window, the Appeals Court said Norton did not err in his decision.
