
An attorney for a Grant County man convicted on drug related charges has been ordered to refile the man’s appeal of his conviction.
In a ruling Wednesday, Associate Court of Appeals Judge Rita Gruber said the appeal does not contain a sufficient statement of the facts that led to the conviction of Randy Hyatt, 45, who is serving a 96-month sentence on one count of possession of methamphetamine and one count of possession of drug paraphernalia.
The court ruling said a statement of case facts not only benefits the court to understand the case but the failure to include it can limit the review of the case.
The attorney was given 15 days from the date of the opinion to file the corrected paperwork.
Hyatt is serving his sentence at the Ester Unit in Pine Bluff and will be eligible to apply for parole on April 7, 025.
