Appeals Court rejects Berryman appeal

A Drew County man convicted of theft of property in 2022 has failed to convince the Arkansas Court of Appeals that his probation was revoked improperly.

Tristan Berryman, 22, pleaded guilty to theft of property in 2022 and was sentenced to five years’ probation. A condition of his probation was to refrain from buying or using drugs, receiving drug counseling and treatment and pay $2,975 restitution at a rate of $100 a month.

After he tested positive for marijuana and methamphetamine use multiple times and failed to attend substance classes, he was unenrolled from the course twice. He also failed to make monthly restitution payments, and a petition was filed to revoke his probation.

After a hearing, his probation was revoked and he was sentenced to three years in a community corrections center, followed by three years suspended imposition of sentence.

The Appeals Court said Berryman failed to make challenges to trial court actions, so the Appeals Court rejected his argument.

He is serving his sentence at the Delta Regional Unit at Dermott and will be eligible to apply for parole in 2026.
