A reported theft in progress in the early morning hours Sunday resulted in the arrest of two men, one of whom is on parole.

Gregory Dukes, 50, and Kevin Maven, 46, were taken into custody after police responded to the reported theft at 3:24 a.m.

Reading from a probable cause affidavit from Detective Chris Wieland, Deputy Prosecutor Mircha King explained the circumstances leading to the arrest.

King said police at the scene saw a red Chevrolet Cruz backed into a space at the Exxon gas station next to the car lot and found Maven in the vehicle.

When he was questioned, he initially said Dukes had asked him to use his vehicle and fell asleep but later admitted that he was the lookout for Dukes.

Dukes refused to answer questions, King said, adding that Dukes has prior felony convictions including for theft and forgery and there is a parole hold for him.

Because of the parole hold, Jefferson County District Judge Kim Bridgforth set a $15,000 bond for Dukes after ruling prosecutors have probable cause to charge him with theft of property, breaking or entering, and criminal mischief. A $10,000 bond was set for Maven on the same allegations and both men were told to come back to court on June 3.
